1. Acceptance of Terms

By accessing or using the GeoKonect website, design tools, calculators, reports, outputs or related technical content, you agree to these Terms of Use.

If you do not agree with these Terms, you must not access or use GeoKonect.

GeoKonect is operated by Kontain Pty Ltd, an Australian-registered company.

2. Purpose of GeoKonect

GeoKonect provides free preliminary design tools for geosynthetic liner and containment systems.

The tools are intended to support early-stage calculation checks, optioneering, sensitivity testing, internal technical review and engineering cross-checking.

The tools are not intended to provide final design, certified design, regulatory design, construction documentation, procurement advice, engineering sign-off or professional certification.

3. Preliminary Design Tools Only

The GeoKonect tools perform simplified or indicative calculations based on user-selected inputs and generalised engineering assumptions.

Outputs may assist with preliminary assessment of matters such as leakage, drainage, wind uplift, anchor trench restraint, soil veneer stability and related containment design checks.

The tools are not a substitute for project-specific engineering design, detailed numerical analysis, independent technical review, regulatory assessment or professional engineering advice.

All outputs must be independently checked, verified and approved by a suitably qualified professional engineer before being relied upon for design, construction, procurement, tendering, regulatory submission, asset management or operational decision-making.

4. User Responsibility

You are solely responsible for all use of GeoKonect tools and outputs.

By using GeoKonect, you acknowledge and agree that you are responsible for:

Selecting appropriate input values.
Checking the accuracy and relevance of all assumptions.
Understanding the limitations of each calculation method.
Reviewing outputs against applicable standards, codes, regulations, specifications and project requirements.
Obtaining independent review by a suitably qualified professional engineer before relying on any output.
Confirming whether any result is suitable for the relevant site, material, loading condition, operating condition or regulatory context.

Kontain Pty Ltd is not responsible for incorrect inputs, misunderstood assumptions, inappropriate use, unverified outputs or any design decision made from GeoKonect results.

5. No Engineering Relationship

Use of GeoKonect does not create a client-consultant, engineer-of-record, certifier, reviewer, adviser, fiduciary or professional services relationship between you and Kontain Pty Ltd.

Kontain Pty Ltd does not act as designer, certifier, reviewer, verifier or engineer of record for any project through the provision of GeoKonect.

No GeoKonect output should be interpreted as project-specific engineering advice, design endorsement, specification approval, regulatory support or construction approval.

You retain full responsibility for all design, construction, procurement, regulatory, operational and commercial decisions.

6. No Warranty

GeoKonect, including all tools, calculators, outputs, reports, assumptions, technical notes and related website content, is provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, Kontain Pty Ltd makes no warranty, representation or guarantee that GeoKonect will be:

Accurate.
Complete.
Current.
Error-free.
Suitable for any particular project or purpose.
Compliant with any specific standard, code, regulation or specification.
Available without interruption.
Free from defects, omissions, calculation errors or data loss.

No written, verbal or implied information provided through GeoKonect creates any warranty, professional duty of care or project-specific obligation.

7. Limitation of Liability

To the fullest extent permitted by law, Kontain Pty Ltd, its directors, employees, contractors, consultants, agents and affiliates are not liable for any loss, damage, claim, cost, delay, penalty, failure or liability arising from or connected with the use, misuse or reliance on GeoKonect.

This includes, without limitation:

Design errors.
Incorrect assumptions.
Construction issues.
Material failure.
Containment failure.
Environmental harm.
Regulatory non-compliance.
Project delay.
Procurement error.
Rework.
Commercial loss.
Loss of profit.
Loss of opportunity.
Contractual penalties.
Third-party claims.
Professional liability claims.
Direct, indirect, incidental, consequential, special or punitive loss.

Your sole remedy is to stop using GeoKonect.

8. Indemnity

You agree to indemnify and hold harmless Kontain Pty Ltd, its directors, employees, contractors, consultants, agents and affiliates from and against any claim, liability, loss, damage, cost or expense, including reasonable legal costs, arising from:

Your use or misuse of GeoKonect.
Your reliance on any GeoKonect output.
Your selection of inputs or assumptions.
Your breach of these Terms.
Your use of GeoKonect outputs in design, construction, procurement, tendering, regulatory submission or project decision-making.
Any third-party claim arising from your use of GeoKonect or derived outputs.

9. Intellectual Property

All intellectual property rights in GeoKonect, including the tools, calculators, calculation logic, reports, outputs, text, graphics, technical material, website content and related documentation, are owned by Kontain Pty Ltd unless otherwise stated.

You may use GeoKonect outputs for internal preliminary review and engineering cross-checking.

You must not, without written permission from Kontain Pty Ltd:

Copy, reproduce or redistribute the tools.
Reverse-engineer the tools or calculation logic.
Modify, resell, licence or commercially exploit the tools.
Create derivative tools or competing calculators based on GeoKonect.
Remove ownership notices, disclaimers or limitations from any output.
Present GeoKonect outputs as certified or independently verified design documents.

10. External Links

GeoKonect may include links to external websites, including Kontain-related websites and other technical resources.

Kontain Pty Ltd is not responsible for the content, accuracy, availability, security or practices of external websites.

Accessing external websites is at your own risk.

11. Privacy and Data

Personal information submitted through GeoKonect may be used to respond to enquiries, manage tool access, improve the tools, communicate relevant updates and operate the website.

Kontain Pty Ltd will handle personal information in accordance with applicable Australian privacy requirements.

You are responsible for ensuring that any information you submit does not breach confidentiality, privacy, contractual or project restrictions.

You should not submit confidential project information unless you are authorised to do so.

12. Tool Changes and Availability

Kontain Pty Ltd may update, modify, suspend, withdraw or discontinue any GeoKonect tool, calculation, output format, page or feature at any time without notice.

Kontain Pty Ltd may also correct, revise or remove content where errors, outdated assumptions or technical issues are identified.

GeoKonect may not always be available, and Kontain Pty Ltd is not liable for interruption, downtime, loss of access or loss of saved information.

13. Prohibited Use

You must not use GeoKonect:

For unlawful purposes.
To misrepresent preliminary outputs as certified design.
To bypass professional engineering review.
To create competing commercial tools.
To copy, scrape, extract or reproduce calculation logic.
To overload, interfere with or compromise the website.
To submit false, misleading, confidential or unauthorised information.

14. Changes to Terms

Kontain Pty Ltd may update these Terms at any time.

Updated Terms will be posted on the GeoKonect website. Continued use of GeoKonect after updated Terms are posted constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of South Australia, Australia.

Any dispute arising from or connected with these Terms or use of GeoKonect is subject to the exclusive jurisdiction of the courts of South Australia, Australia.

16. Entire Agreement

These Terms, together with any privacy notice, disclaimer or legal notice published on the GeoKonect website, form the entire agreement between you and Kontain Pty Ltd regarding your use of GeoKonect.

If any provision is found to be invalid, unlawful or unenforceable, the remaining provisions continue in full force and effect.
